Educational Intimidation Bills

A new report released by PEN America documents a rise in laws that are designed to intimidate educators and librarians. The aim of these laws is to promote self-censoring. Rather than making headlines for banning books, those who wish to promote certain ideologies by limiting students’ access to books are using intimidation tactics. Their objective is to evoke fear that prompts educators and librarians to disregard topics and materials that might cause controversy.

What are intimidation laws?

According to pen.org, “Educational intimidation bills are part of the broader, ongoing ‘Ed Scare’—a nationwide effort documented by PEN America to foment anger and anxiety about public education; to restrict or prohibit instruction about race, sexuality, and gender; and to ban books that address these topics.”

In a report titled Educational Intimidation: How “Parental Rights” Legislation Undermines the Freedom to Learn, the organization examines the rise of educational intimidation bills, “a category of legislation that has the effect of prompting self-censorship in schools through indirect mechanisms, rather than direct edicts.” While PEN America has documented some intimidation bills affecting higher education, the majority of these laws target K-12 educators.

In its Index of Educational Intimidation Bills, PEN America identifies nearly 400 such bills that have been introduced in state legislatures between January 2021 and June 2023, and they have categorized bills by their intent. These bills generate fear, intimidation, or insurmountable obstacles in the following ways:

  • Requiring teachers to post all instructional or professional development materials on public websites so that citizens can easily access these materials and issue objections  
  • Restricting students’ access to school libraries or empowering individual parents to gain control over which materials are allowed in school libraries
  • Inviting parents to opt students into or out of certain content, greatly complicating school schedules and creating individually designed curricula that tears away at the unifying fabric of public school environments
  • Expanding the definition of obscenity beyond its existing legal definition, and threatening educators and librarians with criminal penalties for violations
  • Requiring teachers to monitor and report students’ gender expression

Many laws are making it easier for a single parent to disrupt the educational opportunities afforded to all students. From telephone tip lines to the filing of anonymous complaints, individual parents are being given increasing control over the professional decisions of educators and librarians. 

How are these laws affecting teachers and librarians?

In an article titled “New Intimidation Laws Lead to Classroom Censorship,” PEN America’s editorial director, Lisa Tolin, provides specific examples of teachers and librarians who have lost professional autonomy over curriculum and reading material based on intimidation. 

For example, an art teacher in Tennessee removed major figures from her teaching of art history because of laws that prohibit the teaching of concepts related to race or sex. She was merely introducing the artists and their work to her students, but because of the personal lifestyles of these artists, she knew she would face opposition. This teacher also noted the elimination of Black History Month observances and reported that third graders who have traditionally taken a field trip to a civil rights museum are now going to a baseball game instead.

There’s the case of a Virginia librarian who was subjected to a library inspection and received challenges that originated from a Moms for Liberty list. A teacher in Georgia was fired after reading My Shadow is Purple, a book that was available at the school book fair and was requested by her students.

In addition to legal actions, teachers and librarians also face personal harassment for defending students’ right to read. An Oklahoma teacher who informed her students about Brooklyn Public Library’s Books Unbanned program was removed from the classroom, but that was only the beginning. She was harassed online with graphic suggestions of violence, imprisonment, and even execution. 

In Louisiana, a librarian who voiced opposition to the proposal of book banning was threatened and harassed to the point that she lived in fear and was unable to sleep. According to the article, “Strangers called her a ‘pedophile’ and a ‘groomer.’ One person filed a public records request for her employment history. Another sent her a message saying, ‘You can’t hide, we know where you live. You have a target on your back. Click click.’”

The battle is becoming exhausting for many teachers and librarians. Facing termination of employment, legal actions, and unrelenting harassment is unhealthy and unsustainable. In short, intimidation is effective because the consequences are overwhelming.

What can be done to battle intimidation laws and their effects?

The first step in addressing intimidation bills and the undue stress they place on teachers and librarians is to become informed. To more fully understand the issue of educational intimidation bills, read PEN America’s full report.

Next, find out what’s going on in your local school district. If you become aware of a book ban, you can report it to PEN America via this online form. PEN America and Penguin Random House have joined parents and students from Escambia County, Florida, in filing a federal lawsuit to challenge the removal of some books and the restrictions placed on many others.

Tzitzimitl

Your story places a lot of emphasis on Tzitzimitl. What is it about this Aztec God that captured your attention?

Tzitzimitl

One of my favorite things about Mesoamerican mythology is this emphasis on exploring and understanding duality. It reminds me that our ancestors were wrestling with our own duality as people, just as we do now. How we can be both beautiful and dangerous, healing and painful, loving and wrathful. That theme is perfectly captured in the legend of Tzitzimitl, a creature who’s almost demon, almost goddess.

In myth, Tzitzimitl is both the protector of children and pregnant women and also a wrathful warrior who attacks the earth whenever there’s an eclipse. She devours and destroys when her loyalties call upon it, but she also protects and uses her power to have mercy on humans. Her character is of great importance throughout the series because I wanted Cece, my main character, to learn that both good and evil wars inside people. It’s our job as we wrestle with them to choose which one wins.

That is such interesting insight. It’s not always a black and white world, and your readers can learn to appreciate that right along with Cece.

Aztec Mythology

Did you spend much time studying Aztec mythology and/or culture before you wrote your books?

I’d studied all kinds of folklore and mythology before writing Cece Rios and the Desert of Souls, but very little of it had been from Latin America, despite my heritage. That changed when I went to visit my abuelo when I was in college, and he told me stories about curanderas and brujas and La Llorona. I came home with a desire to learn more, and after researching all kinds of folktales and myths, inspiration struck, and I started writing Cece.

Las Brujas (The witches)

In fact, one of the reasons I love to write is because it’s one of the best ways to learn. Want to know more about folklore? Write an article or story about it, and you’ll find yourself encountering all kinds of questions that send you hunting excitedly for answers. That process also connected me more and more with my culture, something I’ll forever be grateful to my abuelo for inspiring.

Monsters/Monstruos

Chupacabra

What do you think are the scariest Aztec monsters?

Honestly, so many Aztec monsters are terrifying! Most Latin American monsters are; in fact, most monsters from mythology across the world is—a testament to the kinds of fears our ancestors wrestled with in even harsher times. But like the horror genre itself, there’s a distinct morality about the terror in Latin American mythology and folklore. There’s usually a reason why something became terrifying, or why terror was inflicted.

In Cece Rios and the King of Fears, I got to include a few of my favorites, including Alux. In the story, he’s a dark criatura, but in actual tradition aluxes were small, magical beings similar to how those of European descent might think of dwarves or fairies or elves. But they had a ferocious side, and they could curse or harm people if they trespassed on their homes, good will, or even nature itself. I took that inspiration into my series because I think the exploration of nature itself being both benign and dangerous is fascinating.

 

Huichol

Another one of my other favorite legendary beings comes from Huichol tradition (the Huichol are direct descendant of the Aztecs): Tukákame

Tukákame

He’s something between a demon and a zombie—an animated corpse that burns at the touch of water and has skeleton birds for minions. He eats human flesh, and he seemed like an appropriate way of exploring destruction in the second book, though I did that more symbolically than outright.

Buñelos

I see that you know how to make buñelos which are amazing. What other Mexican foods do you like to make (or eat!)?

Yes, I adore buñelos! I’m quite happy to say I’ve gotten pretty great at timing exactly how long they need to fry for, too.

I also like making enchilada sauce from scratch. Well, “like” might be a strong word—it takes a few hours, so I’m sometimes reluctant to start, but chile sauce really does taste better when it’s fresh, not from a can.

Spanish rice and refried beans are also a classic, so I can’t not mention them (or I won’t, at least, hah!). Spanish rice with garlic smashed with the side of a knife? Mmm. The smell fills up your whole kitchen, and I love that. Refried beans that taste fresh, not canned? All half-smashed by hand in a pan? An absolute must.

 

This is one I don’t make myself, but I also really like gansitos. My friend introduced them to me a bit later in life, and now I can’t quite get over the perfect blend of cinnamon, vanilla cake, chocolate, and raspberry filling. It might be junk food, but it’s my junk food. I even had them at Cece Rios and the King of Fears’ launch party!

I see from your website that you’re part British, part Mexican-American. Any plans of focusing on your British roots for upcoming stories?

I do, actually! Well, I suppose I should say I have plans to combine my heritages together in my stories, to embrace the mix I was born with. I have a YA fantasy that will combine the Victorian language of flowers, and certain aspects of British culture, with an Aztec kingdom steeped in old magic. Plus, a playful middle-grade written with a narrator that nods toward old British fairytales, but focused on latine main characters and setting.

ALA’s Rainbow Book Month

The American Library Association’s Rainbow Book Month is an opportunity for book lovers and libraries to discover and share the very best in LGBTQ+ literature. Check out their Rainbow Book List. This resource showcases over 190 books for young readers from birth to age 18.

 

At a time when censorship threatens accessibility to books that support LGBTQ+ young people and their families, the ALA is dedicated to fighting censorship. “We know that there are individuals who will try to censor these books, but we offer this carefully curated list to the multitude of youth advocates working in our communities to connect young readers to the books that they so desperately need.”

The CBC Celebrates Pride 

The Children’s Book Council maintains an ongoing list of LGBTQ+ inclusive books appropriate for five different categories of young readers. Browse books for 8-11-year-olds here. For a more comprehensive assortment, check out the complete list of LGBTQ+ inclusive books for children and young people here.

 

Additionally, the CBC also offers home learning education packs for educators, parents, and caregivers. Through these learning packs, the CBC provides age-appropriate resources to support young learners in understanding that there are many different types of families.

 

For Young Adult readers, the CBC is focusing on graphic novels and comics. Their 2023 Celebrate Pride with Comics campaign highlights a list of new YA graphic novels. For comic book fans, they also showcase Marvel and DC comics that feature LGBTQ+ characters.

LGBTQ Reads

 

Looking for a list of LGBTQ+ books for middle grade readers? Check out the LGBTQ Reads book list for middle grade readers. The site offers book lists sorted by age-level appropriateness, and the middle grade list is extensive!

 

The LGBTQ site is dedicated to promoting curated reading lists for all ages. They provide links to book details and purchasing platforms. According to their website, LGBTQ Reads works to update lists on a regular basis. They’re also open to feedback from authors who feel their books may need to be added or recategorized.

WNDB Walter Grant

The Walter Dean Myers Grant program provides grants of $2,000 each to promising diverse writers and illustrators who are currently unpublished. In addition to a grant for disabled writers, there are two Walter Grants being offered for trans writers and illustrators.
